
Webinar: “Spanish Register of Product Producers (BDO) and EPR Obligations for Companies Exporting to Spain”
Tedalian Enterprise Services was invited by the Wielkopolska Development Fund (Wielkopolski Fundusz Rozwoju) to deliver an expert webinar on the obligations arising from Spanish Extended Producer Responsibility (EPR) regulations. The webinar was designed for Polish companies exporting packaged products to the Spanish market, as well as businesses planning to launch sales in Spain.
The objective of the webinar was to provide companies with a clear understanding of the new administrative obligations arising from the Spanish Extended Producer Responsibility system and to explain the registration process for foreign producers in Spain’s Register of Product Producers. Tedalian experts presented the practical steps required to adapt business operations to the regulatory framework introduced following the entry into force of Royal Decree 1055/2022, and explained how these requirements affect companies placing packaged products on the Spanish market.
The webinar provided a detailed overview of how the Spanish EPR system operates and explained the roles of the different parties involved in packaging waste management. Participants gained an understanding of the relationship between the producer, Authorised Representative, collective Extended Producer Responsibility scheme (SCRAP) and the Spanish Ministry for the Ecological Transition and the Demographic Challenge (MITECO), which is responsible for maintaining the Register of Product Producers. The session also covered packaging record-keeping requirements, annual reporting obligations and the financing of the packaging waste management system.
One of the key topics was the role of the Authorised Representative, whose appointment is mandatory for producers that are not established in Spain. Tedalian experts explained the representative’s responsibilities, the process for granting the required power of attorney and the obligations associated with representing foreign producers before Spanish public authorities and producer responsibility organisations. The webinar also presented Tedalian’s comprehensive EPR services for foreign producers exporting their products to Spain.
A significant part of the session was dedicated to the practical implementation of the registration process. Participants were guided through the successive stages of obtaining a Spanish Tax Identification Number (NIF), obtaining a digital certificate, entering into an agreement with the appropriate producer responsibility organisation, registering the producer with the Register of Product Producers and preparing annual declarations concerning the quantities of packaging placed on the Spanish market. The webinar also addressed the requirement to include the producer’s registration number on commercial documentation and explained the practical aspects of maintaining accurate packaging records.
The final part of the webinar focused on forthcoming legislative changes and additional obligations scheduled to enter into force in the following year. These included new packaging labelling requirements relating to waste separation and the extension of reporting obligations to industrial and commercial packaging. This forward-looking approach enabled participating companies to prepare their organisations in advance for upcoming regulatory changes.
